North Dakota Tribal Gaming

North Dakota entered into tribal gaming compacts with five tribes in 1994. All five compacts were subsequently amended and went into effect in 2013 with a 10-year term. New amendments to the compacts were approved by the U.S. Department of the Interior and published in the Federal Register on December 19, 2022; the amended compacts expire in December 2032. The five compacted tribes are the Sisseton-Wahpeton Sioux Tribe, Spirit Lake Tribe, Standing Rock Sioux Tribe, Three Affiliated Tribes (Mandan, Hidatsa and Arikara), and Turtle Mountain Band of Chippewa Indians. The amended compacts authorized mobile sports betting within the physical boundaries of each reservation. Tribes in North Dakota do not share Class III gaming revenue with the state. The minimum gambling age at tribal casinos in North Dakota is 19. There are no limits on the number of gaming machines or tables tribes may operate.

In early 2025, the Spirit Lake Tribe proposed developing a casino in or near Grand Forks — an off-reservation location — which generated community pushback and concerns about lack of prior consultation with affected municipalities.
