Montana Online Gaming

In May 2025, Montana became the first state in the U.S. to explicitly ban online sweepstakes casinos. Governor Greg Gianforte signed SB 555 into law after it passed both chambers of the legislature in April 2025. The law, effective October 1, 2025, amends Montana's existing gaming statutes to include in the definition of illegal "internet gambling" any online casino platform — including sweepstakes-model gaming sites — that knowingly transmits or receives gambling information, allows consumers to place a bet or wager using any form of currency, and makes payouts of any form of currency.

In January 2017, Montana passed SB 25, which exempts fantasy sports leagues from the "gambling" classification provided the entry fee is no greater than $35, leagues last the whole season and prizes are of minimal monetary value.

The state's legislature put forth House Joint Resolution No. 21 in 2017, which seeks to evaluate and study daily fantasy sports in order to clarify its legality.
