In March 2019, the West Virginia Lottery Interactive Wager Act automatically became law when Gov. Jim Justice let the veto window pass. The law legalized online casino gambling in West Virginia, providing one license for each of West Virginia's five casinos.

Following passage of the Interactive Wagering Act, the Lottery adopted implementing regulations, and the first online casino platforms launched in 2020, with subsequent brands added over the next several years.

Online casinos that operate in the state, include BetMGM, Caesars, DraftKings, FanDuel, and Fanatics. These online casinos offer a mix of slots, table games, and some online poker and specialty products, all geofenced to players physically located within West Virginia’s borders.Each online casino must be linked to one of the five land-based casino licensees, and the Lottery regulates interactive gaming alongside its oversight of video lottery and table games.
